2. Acceptance of Terms
By using this website or engaging Webitizer services, you agree to these Terms of Service. If you do not agree, please do not use this website or submit inquiries through our contact form.
These terms apply to visitors of the Webitizer website and to clients who engage our services. More detailed terms specific to your engagement may be provided in a separate written service agreement. In the event of a conflict between these terms and a written service agreement, the written agreement governs.
3. Services We Provide
Webitizer provides website-related services including:
- Website design and development
- Web hosting and domain setup assistance
- Website maintenance and technical support
- Contact and lead form integration
- Client portal and admin dashboard access (depending on service tier)
- Third-party platform integration (hosting, email, analytics, payments)
Services are delivered based on the agreed scope for each client. Scope, deliverables, and timelines are defined in the service agreement or proposal for your engagement.
4. Service Tiers
Webitizer offers three service tiers. The specific features, pricing, and support hours for each tier are described on our website and in your individual service agreement.
Essential Website
A professional website with hosting setup, contact form, basic SEO, and standard monthly support. Designed for businesses that need a clean, functional web presence.
Growth Website
Everything in Essential plus lead capture, lead database, and basic reporting. Designed for businesses actively generating and tracking leads.
Business Platform
Everything in Growth plus a client portal, admin dashboard, ticket system, file uploads, advanced analytics, and role-based access. Designed for businesses that need a full client-management platform.
5. Proposals, Estimates, and Scope
Work is based on an agreed scope defined in your service proposal or written agreement. Scope defines what is included, what the deliverables are, and what the timeline is.
- Requests that fall outside the agreed scope are treated as change requests
- Change requests may require a separate approval and may result in additional fees
- Estimates and proposals are valid for a reasonable period after delivery (typically 30 days unless noted)
- A signed agreement or written authorization is required before work begins
6. Client Responsibilities
Clients are responsible for:
- Providing accurate and complete information during onboarding and throughout the engagement
- Supplying content, images, logos, branding materials, and other assets needed for your website
- Reviewing and approving drafts and deliverables in a timely manner
- Maintaining access to any accounts you own (domain registrar, third-party platforms, etc.)
- Notifying us promptly of any changes that affect your website or service
Delays caused by a client’s failure to provide required materials or approvals may affect project timelines. Webitizer is not responsible for delays caused by client-side factors.
7. Payments and Billing
Webitizer services are billed as follows:
- Setup fee: A one-time fee for initial design, development, and launch of your website. Specific amounts are defined in your service agreement or proposal.
- Monthly plan: An ongoing monthly fee for hosting, maintenance, support, and platform access. Billing begins after your site launches unless otherwise agreed.
- Invoices and payment links: Invoices or payment links will be sent for all fees. Payment is due by the date shown on the invoice.
Accounts with overdue balances may result in paused services, including paused maintenance, support, or access to the client portal. Repeated non-payment may result in service termination.
Payment processing may be handled through Stripe or another approved payment platform. Detailed billing terms, due dates, and late payment policies will be specified in your service agreement.
8. Refunds and Cancellations
- Setup fees: Setup fees are generally non-refundable once work has begun. If you cancel before any work starts, a refund may be considered at our discretion.
- Monthly plans: You may cancel your monthly plan at any time. Cancellation takes effect at the end of the current billing cycle. No mid-cycle refunds are issued unless otherwise agreed in writing.
- No future billing: After a valid cancellation, no additional monthly charges are applied beyond the current billing period.
For cancellations, please notify us in writing (email is acceptable) as early as possible. Additional terms may be outlined in your specific service agreement or invoice.
9. Revisions and Change Requests
Monthly support is designed to keep your website running, updated, and maintained. It is not unlimited redesign time. Support hours are defined in your service agreement.
- Minor content updates and bug fixes are included in standard support
- New page designs, layout overhauls, and significant feature additions are out-of-scope requests
- Out-of-scope work may be quoted and billed separately as a change request
- We will communicate scope concerns before performing out-of-scope work
10. Hosting, Domains, and Third-Party Services
Webitizer websites may use third-party platforms to deliver services. Currently these include:
- Hostinger (web hosting)
- Supabase (database and authentication)
- Resend (transactional email)
- Cloudflare (bot protection and DNS)
- Google Analytics / Google Search Console (analytics)
- Stripe (payment processing)
Each third-party platform has its own Terms of Service and Privacy Policy. By using Webitizer services, you acknowledge that certain aspects of your website’s operation are governed by those third-party terms.
Account ownership arrangements (whether Webitizer holds the hosting account or the client does) will be specified in your service agreement.
11. Ownership and Licensing
- Your content: You retain ownership of all content you supply — text, images, logos, brand assets, and business data.
- Your deliverables: Upon completion of a paid engagement and subject to full payment, you receive the agreed website deliverables (design, content, configuration) for your use.
- Webitizer platform: Webitizer retains ownership of its platform code, templates, backend systems, admin tools, portal infrastructure, automation workflows, and internal tooling. These are not transferred to clients unless explicitly agreed in writing.
- Third-party assets: Any third-party fonts, icons, or libraries used in your project are subject to their respective licenses.
If you have questions about what you receive as a deliverable vs. what remains Webitizer property, ask before your project begins. We are happy to clarify.
12. Migration and Offboarding
If you choose to end your service relationship with Webitizer:
- You may request an export of your content, website files, and data, provided your account is paid and current
- Export and migration requests will be honored within a reasonable timeframe (typically 10 business days)
- Migration assistance — such as setting up hosting with another provider, DNS transfers, or deploying your site elsewhere — is available as a billable service at an agreed rate
- Webitizer’s platform code, backend systems, templates, and shared tooling are not included in client migrations by default
The specific deliverables you receive upon offboarding will be defined in your service agreement.
13. Acceptable Use
You agree not to use the Webitizer website or any services we provide to:
- Conduct illegal activities or violate applicable laws or regulations
- Distribute spam, malware, or other harmful content
- Harass, threaten, or harm other individuals or businesses
- Attempt to access, probe, or bypass security systems
- Infringe on the intellectual property rights of others
- Misrepresent your identity or business
We reserve the right to refuse or terminate service to any client or user who violates these acceptable use standards.
14. No Guarantee of Results
Webitizer delivers professional website design and maintenance services. We do not guarantee specific outcomes including search engine rankings, website traffic, leads generated, sales, or revenue. Results depend on many factors outside our control, including market conditions, competition, and your business operations.
15. Limitation of Liability
To the fullest extent permitted by law, Webitizer’s liability to you for any claim arising from these terms or from the services provided is limited to the fees you paid for the specific service at issue in the prior three months.
Webitizer is not liable for:
- Loss of profits, revenue, data, or business opportunities
- Downtime, data loss, or disruptions caused by third-party services (hosting, database, email, etc.)
- Security incidents beyond our reasonable control
- Issues caused by client-supplied content or third-party integrations
This limitation applies regardless of the legal theory of the claim (contract, tort, negligence, etc.). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability — in those cases, liability is limited to the maximum extent permitted by law.
16. Privacy
Your use of this website and our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
17. Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will update the effective date at the top of this page. Continued use of this website or our services after changes are posted constitutes your acceptance of the updated terms. For material changes, we will make reasonable efforts to notify active clients directly via email.
